In August 2018, a jury in California found, for the first time, that Monsanto's RoundUp and Ranger Pro herbicides were unsafe and caused plaintiff DeWayne Johnson to develop cancer (Non-Hodgkin’s Lymphoma), and the jury awarded Johnson $39.25 million in compensatory damages and $250 million in punitive damages. While Monsanto is challenging the jury’s verdict, there is substantial uncertainty in the industry about what this verdict means in connection with thousands of similar lawsuits around the country and otherwise. Ross Johnson of Faegre Baker Daniels LLP will discuss the basis for the lawsuit, the positions of the parties at trial, the verdict, Monsanto’s grounds for challenge of the verdict, and potential future implications of the verdict on industry participants and others.
