ARA Co-Signs a Letter Opposing Broad Reporting Requirements for PFAS in Minnesota

ARA co-signs a letter opposing SF 834, legislation that would impose broad reporting requirements on manufacturers of all products containing PFAS sold in Minnesota, ban the sale of products containing a variety of product categories, and establish a future regulatory scheme to ban additional product categories containing PFAS.

ARA and the undersigned organizations write that the legislation is overly broad, lacks scientific basis, and will have significant unintended consequences.

More details:

  • SF 834, beginning 1/1/25, bans the sale or distribution of the following products if the product contains intentionally added PFAS: carpets or rugs; cleaning products; cookware; cosmetics; dental floss; fabric treatments; juvenile products; menstruation products; textile furnishings; ski wax; or upholstered furniture.
  • By 1/1/32, the bill bans the sale or distribution of any product that contains intentionally added PFAS, unless the commissioner has determined by rule that the use of PFAS in the product is a currently unavoidable use.
  • The bill allows the Minnesota Pollution Control Agency (PCA) to identify products by category or use that may be banned if they contain intentionally added PFAS. The PCA must prioritize the bans based on whether the products are most likely to cause contamination of the state's land or water resources. The PCA may exempt products in which the use of PFAS is a currently unavoidable use.
  • Reporting – The bill requires, beginning 1/1/26, that a manufacturer of a product that contains intentionally added PFAS must submit to the commissioner a written notification that describes the purpose of the PFAS; the amount of each PFAS, and any additional information required by rules. The PCA may waive all or part of the notification requirement if it determines that substantially equivalent information is already publicly available.
