Pesticide Policy Coalition Letter on CWA Permit Reform

ARA co-signed a letter as part of the Pesticide Policy Coalition in support of the House Transportation & Infrastructure (T&I) Committee-approved Clean Water Act (CWA) permitting reform bills, including H.R. 5089, the “Reducing Regulatory Burdens Act of 2023”.

Ag retailers provide essential ground and aerial pesticide application services for the nation’s farmers and their rural communities. EPA’s National Pollutant Discharge Elimination System (NPDES) pesticide general permit has been imposed for aquatic pesticide applications since 2011 due to an erroneous federal court decision. 

Under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), EPA already approves and issues a registration for pesticide products only after it is determined the product will not cause “unreasonable adverse effects on the environment”.  

ARA supports HR 5089, common-sense legislation that eliminates redundant and unnecessary regulatory burdens and the risk of costly citizen suits while continuing to protect the environment.
