ARA Applauds Supreme Court Decision Upholding Federal Pesticide Preemption in Monsanto v. Durnell

Jun 25 2026

ARLINGTON, Va. — The Agricultural Retailers Association (ARA) today praised the U.S. Supreme Court's ruling in Monsanto v. Durnell, which upheld the preemptive authority of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) over state tort claims alleging failure to warn.

"This decision protects the entire agricultural supply chain. When ag retailers and applicators comply fully with an EPA-approved label, they should not be punished for following the law. The Court's ruling ensures that pesticide safety decisions remain grounded in science, exactly as Congress intended when it passed FIFRA," said Daren Coppock, ARA President & CEO.

ARA has long advocated for national uniformity in pesticide regulation, arguing that allowing state courts to impose additional warning requirements beyond those approved by EPA would create an unworkable patchwork of liability that undermines compliance, raises costs, and restricts farmer access to essential crop protection tools. SCOTUS's ruling preserves the integrity of that framework.
